Virginia McMichael successfully represented the appellee on an appeal from an order of the Orphans Court Division of the Montgomery County Court of Common Pleas holding the defendant in contempt of court for failing to turn over funds belonging to his parents, who had been adjudicated incapacitated.

On appeal to the Superior Court of Pennsylvania, the son argued that the Orphans Court lacked jurisdiction to hold him in contempt of court. The trial court agreed with McMichael’s argument that the Orphans Court had subject matter jurisdiction. The Superior Court affirmed the trial court’s orders holding defendant in contempt of court and denied his petition for a writ of habeas corpus.

In another matter, Virginia McMichael represented a trust beneficiary in a dispute with an insurance company. McMichael was the main drafter of briefs in the Orphans Court and the Pennsylvania Superior Court and succeeded on a motion to quash an appeal to the Superior Court.
